SWMS Requirements in New Zealand

Safe Work Method Statements (SWMS) are a cornerstone of safe work planning. If you work across New Zealand and Australia, it is worth understanding how the requirements differ — because the legal position is not the same on both sides of the Tasman.

What is a SWMS?

A Safe Work Method Statement is a document that sets out the high-risk activities of a job, the hazards they create, the control measures to manage those hazards, and how the work will be carried out safely. It is a practical, job-specific plan that workers read and sign before starting.

The New Zealand position

In New Zealand, the Health and Safety at Work Act 2015 (HSWA) does not mandate a document called a "SWMS" in the way Australian law does. Instead, HSWA requires every PCBU (person conducting a business or undertaking) to identify hazards and manage risks so far as is reasonably practicable. A SWMS or job safety analysis is one of the most effective and widely used tools for meeting that duty, especially in construction and trades.

In practice, principal contractors and clients on commercial and construction sites routinely require documented SWMS before work begins, so for most contractors they are effectively expected even though the term itself is not written into the Act.

The Australian difference

Under Australian WHS law, a SWMS is a specific legal requirement for High Risk Construction Work (HRCW) — such as work at height, near energised electrical installations, in confined spaces or near mobile plant. If you operate in Australia, a compliant SWMS for HRCW is mandatory.
